Bye-laws for City Hall grounds

Interpretation

1. In these bye-laws - ‘the Council’ means Belfast City Council. ‘the Grounds’ mean the grounds of the City Hall, Belfast, including the Garden of Remembrance. ‘offence’ means an offence under these bye-laws and relating to an act committed at or in the Grounds.

2. These bye-laws shall have effect with regard to the Grounds.

3. Nothing in these bye-laws shall -

(a) interfere with or prevent the carrying on of any work in, or supervision and management of, the Grounds by officers of the Council or any other person so authorised by the Council;
(b) prevent the Council from entering into an agreement in respect of the use of the Grounds or any part thereof and pursuant to which an act is permitted which would otherwise be prohibited.

Public Access

4. It shall be an offence for any person to -

(a) enter or leave the Grounds except by way of the gates or other authorised access points provided by the Council for that purpose;
(b) enter or remain in the Grounds at any time that they are closed to the public.

Protection of Property

5. It shall be an offence for any person to -

(a) wilfully damage or deface any wall, fence or hedge situate in or enclosing the Grounds, or enclosing any area within the Grounds;
(b) affix any unauthorised notice, banner or bill, or attach any bicycle or other article to any wall, fence, gate, hedge or tree, or any statue or other structure;
(c) climb any tree or any statue or other structure;
(d) wilfully damage, deface or displace any statue or other structure or any seat, ornament, barrier, or any machine or implement provided for the purposes of the Grounds;
(e) light any ﬁre;
(f) use a metal detector;
(g) ride a bicycle, or ride on a skate-board or roller boots, or any similar apparatus.

Protection of Flora and Fauna

6. It shall be an offence for any person to wilfully -

(a) damage, remove, cut or interfere with any turf, or any ﬂower, shrub, tree or other plant;
(b) walk or run over or otherwise disturb any ﬂower bed or any ground set apart for the cultivation of plants;
(c) take or disturb or destroy the nest or egg or any bird.

Protection of the Public

7. It shall be an offence for any person to -

(a) throw or discharge any missile or play any ball game;
(b) use abusive, indecent, or obscene language likely to give reasonable cause for annoyance to other persons;
(c) play any radio, cassette player or similar device, or any musical instrument in a manner likely to disturb or give reasonable cause for annoyance to other persons;
(d) operate any power-driven model toy or aircraft;
(e) wilfully obstruct, disturb or annoy any member of the public resorting to the Grounds;

General Management

8. It shall be an offence for any person to -

(a) erect any stall, stand, post, tent or other structure;
(b) offer or expose for sale or hire any article, commodity or service;
(c) beg from or importune any other person resorting to the Grounds;
(d) obstruct any officer of the Council or constable in the proper execution of his duty.

Public Meetings

9. (a) No person shall preach, lecture, or take part in any meeting for political, religious, or any other purpose, or take part in any public show, performance or demonstration, except with the prior consent of the Council and in such part of the Grounds as may be set aside by the Council for that purpose.
(b) No person shall solicit or collect money in connection with any meeting, performance, or demonstration, save that organised collections may be taken up at and in connection with any permitted political or religious meeting, or as otherwise permitted by the Council.
(c) Any person attending such meeting or demonstration shall conduct himself in an orderly manner.
(d) No loudspeaker shall be used in any part of the Grounds except with the prior permission of the Council.

Dogs and Other Animals

10. (a) A person having charge of a dog shall keep the dog on a lead and under proper control, and restrained from giving reasonable cause for annoyance or alarm to other person, provided that the requirement to keep the dog on a lead shall not apply in the case of a registered blind person.
(b) A person shall not bring into the Grounds any animal (other than a dog) the presence of which is likely to give reasonable cause of alarm to other persons.

BYE-LAWS made the ﬁrst day of July 1997 by BELFAST CITY COUNCIL under section 90 of the Local Government Act (Northern Ireland) 1972.

Integrated Quality and Environmental Policy Statement

The role of Belfast City Council's Commercial and Procurement Services (CPS) is to develop and embed a consistent corporate approach to commercial and procurement activity, with an emphasis on maximising the Councils commercial position and generating positive outcomes for Belfast and the people of Belfast.

We will do this by driving effectiveness, efficiency and improvement of procurement processes and deriving value from all procurements and all income generation opportunities. CPS will support and contribute to the success of the Belfast Agenda and corporate vision through the key themes of ensuring compliance, adopting a collaborative and customer focused approach, developing and embedding a corporate approach to commercial and procurement activity.

Belfast City Council (BCC) recognises the actual and potential impact its spend has on the environment, and on the local economy, suppliers & communities in Belfast. This policy outlines the approach that CPS will take to integrate sustainability into the procurement of goods, works and services in order to optimise the economic, social and environmental benefits, in line with ISO 14001:2015. In addition, to accomplish and to maintain a high quality of service to meet the need of clients, we have integrated the requirements of ISO 9001:2015 which will provide a framework to continually improve the effectiveness of how we work and the consistency of quality to our clients.

Through the ongoing implementation of the CPS's Integrated Management System (IWIS), we will therefore:

Commit to fulfil all applicable compliance obligations including statutory, stakeholder and industry commitments and agreements.
Commit to deriving value by procuring goods, works and services to the benefit of the people, the communities and the economy of Belfast from all procurement opportunities and third party expenditure
Commit to reduce the environmental impacts of the Council and our supply chain through the adoption of a strategic, formal approach to environmental procurement
Commit to maintain focus and resilience and continually improve the unit's performance through the IMS in the face of unprecedented internal and external change.

Key elements of the unit's commitments therefore are:

Where practicable, we will seek to support BCC in spending money on procuring goods, works and services to the benefit of the people, the communities and the economy of Belfast. This specifically includes the use of Social Clauses in Council Contracts and where applicable the use of Article 20. We will encourage and persuade suppliers to continue to identify and integrate sustainable processes and products and to enhance their understanding of the Council's sustainability commitments.
We will seek to understand the impact of and implement the council's stance on both the Circular Economy and employability
We will develop and implement a process for the identification and integration of sustainability criteria into the procurement process including the specification of goods, works and services, selection of suppliers and award of contracts and will seek to use this approach to support capacity building and incremental improvement of performance.
